Terms of Use
Terms of Use
1. About these Terms
These Website Terms of Use (“Terms”) apply when you access or use the Dolare Care Pty Ltd website at www.dolarecare.com.au, including its pages, forms and other online features (“Website”). In these Terms, “Dolare Care”, “we”, “us” and “our” mean Dolare Care Pty Ltd. “You” and “your” mean any person who accesses or uses the Website. By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
2. About Dolare Care
Dolare Care provides disability support services, including services funded through the National Disability Insurance Scheme (NDIS), and also delivers selected Support at Home services through partnership arrangements with PlanCare ONEteam. Information on this Website is intended to help participants, clients, families, representatives, support coordinators, healthcare professionals and other visitors understand our organisation and services.
3. General Information Only
The information on this Website is general information only. It does not constitute:
- medical, clinical or mental-health advice;
- legal or financial advice;
- independent disability advocacy;
- an assessment of your individual support needs;
- confirmation that a particular support is reasonable and necessary;
- confirmation that a service will be funded by the NDIS or another funding body; or
- a guarantee that Dolare Care can provide a particular service.
You should obtain appropriate professional advice for your individual circumstances. Decisions about NDIS eligibility, plans, budgets and funding are made by the relevant government agency or funding body. Dolare Care does not control or guarantee those decisions.
4. Emergencies
The Website is not an emergency or crisis-response service and is not continuously monitored.
If you or another person is in immediate danger or requires urgent medical assistance, call 000.
Do not use a website contact or referral form to report an emergency, immediate safety risk or time-critical incident.
5. Service Information and Availability
We take reasonable care to keep information about our services accurate and current. However, services, service areas, staffing, fees and availability may change. Information displayed on the Website does not guarantee that:
- a service is currently available;
- we have a suitable worker available;
- we can meet a person’s particular support needs;
- a referral will be accepted;
- services will begin by a requested date; or
- a funding body will pay for the requested service.
Before commencing services, we may need to complete an intake process, assess whether we can safely meet the person’s needs, confirm funding arrangements and enter into a separate service agreement.
6. Referrals and Enquiries
You may use the Website to make an enquiry or submit a referral. Submitting a form:
- does not create a service relationship;
- does not require Dolare Care to accept the referral;
- does not guarantee service availability;
- does not reserve a support worker or commencement date; and
- does not replace a participant service agreement.
We may contact the person making the referral, the prospective participant, their representative or other relevant parties to obtain more information. If you submit information about another person, you confirm that:
- you are authorised to provide the information;
- the information is accurate to the best of your knowledge;
- the person has been informed about the referral where appropriate; and
- providing the information does not breach confidentiality, privacy or another legal obligation.
Please avoid including unnecessary medical or sensitive information in a general enquiry. Required information can be collected securely during our intake process.
7. Participant Service Agreements
These Website Terms only govern use of the Website. They do not govern the delivery of disability services. If Dolare Care agrees to provide services, the services will be governed by a separate written agreement or arrangement that may address:
- the supports to be provided;
- service dates and times;
- fees and claiming arrangements;
- provider travel and transport;
- cancellations;
- the responsibilities of each party;
- complaints and feedback;
- changes to services; and
- ending or transitioning services.
If there is an inconsistency between these Website Terms and a signed service agreement concerning the delivery of services, the service agreement will apply to that service-related issue.
8. Accuracy of Information You Provide
You agree to provide information that is accurate, current and complete. You must not knowingly provide:
- false or misleading information;
- information that impersonates another person;
- another person’s confidential information without authority;
- unlawful, threatening, discriminatory or abusive content;
- malicious software or harmful computer code; or
- content that infringes another person’s rights.
Please notify us if information relevant to an enquiry or referral changes.
9. Acceptable Use
You may use the Website only for lawful purposes. You must not:
- interfere with the Website’s operation or security;
- attempt to gain unauthorised access to the Website, its systems or information;
- introduce viruses, malicious code or other harmful technology;

- use the Website in a way that breaches any applicable law.
We may restrict or block access where reasonably necessary to protect the Website, Dolare Care or other people.
10. Intellectual Property
Unless otherwise stated, the Website and its content are owned by or licensed to Dolare Care. This includes:
- business names and branding;
- logos and graphic elements;
- written content;
- photographs, illustrations and videos;
- downloadable materials;

You may view the Website and print or download reasonable extracts for your personal, non-commercial use.
You must not copy, modify, reproduce, publish, distribute, sell, license or commercially exploit Website content without our prior written permission, unless permitted by law. Third-party names, logos and trademarks remain the property of their respective owners.
11. Privacy
We handle personal information submitted through the Website in accordance with our Privacy Policy and applicable privacy and health-records legislation. By submitting information through the Website, you acknowledge that we will collect and handle it for the purposes described in our Privacy Policy and any collection notice displayed with the relevant form. Our Privacy Policy is available through the Website.
12. Electronic Communications
You may contact us through email, telephone or Website forms. Although we take reasonable steps to protect information, ordinary email and internet communications may not always be secure. You should avoid sending unnecessary sensitive information through unsecured channels. We may keep records of communications where reasonably necessary for service delivery, administration, quality, safety, legal compliance or responding to an enquiry.
13. Third-Party Websites and Services
The Website may contain links to external websites, including government agencies, NDIS resources or other service providers. These links are provided for convenience and general information. Unless expressly stated, Dolare Care does not control, operate or endorse third-party websites. We are not responsible for:
- their content or availability;
- their privacy or security practices;
- information, products or services they provide; or
- loss resulting from your use of them.
You should review the terms and privacy policies of external websites before using them or providing personal information.
14. Website Availability and Security
We take reasonable steps to maintain the Website and protect it from security threats. However, we do not guarantee that:
- the Website will always be available or uninterrupted;
- every feature will operate without error;
- information will always be completely current;
- the Website will be free from viruses or harmful components; or
- information transmitted over the internet will be completely secure.
We may suspend, modify or discontinue part or all of the Website where reasonably necessary for maintenance, security, operational or business reasons. You are responsible for using suitable security precautions when accessing the Website, including maintaining current device and antivirus protection.
15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or another applicable law. Where a guarantee, right or remedy cannot legally be excluded, these Terms operate subject to that guarantee, right or remedy.
16. Liability
To the extent permitted by law, Dolare Care is not liable for loss arising solely from:
- reliance on general Website information instead of obtaining appropriate professional advice;
- inaccurate or incomplete information supplied by a Website user;
- the temporary unavailability of the Website;
- use of a third-party website;
- unauthorised conduct outside our reasonable control; or
- use of the Website in breach of these Terms.
This limitation does not apply to liability that cannot legally be excluded or limited. It also does not limit any obligations Dolare Care has under a participant service agreement, the NDIS Code of Conduct, applicable NDIS Practice Standards or other applicable laws.
17. Complaints and Feedback
We welcome feedback about the Website and our services. If you have a concern about Website information or functionality, please contact:

Complaints about supports or services will be handled under our complaints management process and applicable NDIS requirements. Making a complaint will not result in unfair treatment or disadvantage.
18. Changes to The Website or These Terms
We may update the Website and these Terms to reflect changes to our services, systems, business practices or legal obligations. The current version will be published on the Website with its effective date. Your continued use of the Website after an update means the revised Terms will apply to your future Website use. Changes to these Website Terms do not automatically amend an existing participant service agreement.
19. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.
20. Governing Law
